Excerpt from The Legal Remedy for Plutocracy To maintain itself, the aristocracy needed the power to tie up its property for more than one life, and it got that power; because the doctrine was gradually extended until at last it was settled that the power to tie up might extend over any number of lives in being and twenty-one years, and nine months if necessary, thereafter. In this shape American lawyers and judges imported this doctrine into this country, because they found it in the only books they read and studied, and they knew no other. They apparently never stopped to think whether it was consistent with the principles of our government, and were caught in its toils before they realized the end to which, under changing conditions, it might lead. Strange to say the bulk of this importation was made after the revolution had separated us from the mother country. Prior to the revolution there were rudimentary beginnings of equitable jurisdiction and doctrines in some of the colonies, and in others none. Now, the full flower blows all over the land.
